Who we are

By placing an order you agree to these Terms. If you do not agree, please do not place an order. We may update these Terms from time to time; see Changes to these Terms below.

Definitions

A few words carry a specific meaning throughout this document:

• Song or Order means the personalized digital audio track, the delivery tier you choose, and any add-on you purchase through the wizard or after checkout.
• Customer Content means the recipient's name, the stories and memories, and any other details you submit in the order wizard.
• Wizard means the step-by-step form at https://customsonggifts.com/quiz used to place an order.
• Delivery means the moment we send the secure download link and MP3 file to the email address on your order.
• Guarantee Period means the 30 days following Delivery, during which you can ask for a full refund of your order, for any reason, under the money-back guarantee described in our Refund Policy.
• Polar means Polar.sh, our payment provider and merchant of record.

The service we provide

Custom Song Gifts creates a personalized song: digital content written and produced for the person you name in the order wizard, based on the answers, stories, and preferences you submit. The song is delivered as a secure download link and an MP3 file sent to your email address. No physical product is shipped.

Every song is produced individually for the order it belongs to. We do not resell one customer's finished song to another customer.

Ordering and how a contract is formed

You place an order by completing the wizard: you choose a recipient, a genre, and the language the song should be written in, answer a short set of questions about the person the song is for, and give your email address and phone number. You then choose a delivery tier and pay on the checkout screen. Payment is processed by Polar.

A contract between you and Custom Song Gifts is formed once your payment is confirmed and we send you an order confirmation email. If we cannot accept your order, for example because the Customer Content breaks the rules under Your content below, we will tell you and refund your payment in full.

Polar, our reseller

Our order process is conducted by our online reseller Polar.sh. Polar is the Merchant of Record for all our orders and handles payments, taxes, receipts and refunds.

Polar's own terms and privacy notice apply to the payment step of your order, in addition to these Terms. Polar, not Custom Song Gifts, appears on your card or bank statement.

Prices, currency, and taxes

Prices are shown in the currency of your country (EUR, SEK, NOK, CZK, HUF, PLN, RON, USD) and include VAT where applicable under your local law. Polar determines and collects any applicable sales tax, VAT, or similar charge based on your location and remits it to the relevant authority.

We may run limited-time offers or discounts. The price you pay is the price shown on the checkout screen at the moment you complete payment.

Delivery times

At checkout you choose one of two delivery tiers. Both include the same full song and differ only in how fast it arrives: with 30-Minute Delivery your song is delivered within 30 minutes of payment, and with 48-Hour Delivery within 48 hours of payment.

These times are best-effort estimates, not guarantees. Delivery can occasionally take longer, for example during unusually high demand or if we need to clarify something in your Customer Content. If a delay looks likely, we will email you with an update.

Add-ons and upgrades

At checkout you can add the lyrics PDF: a printable PDF of your song's lyrics with the recipient's name. It is delivered together with the song, by email and on your song page.

After checkout, the confirmation page lets you upgrade from 48-Hour Delivery to 30-Minute Delivery by paying the difference between the two tier prices, as long as your song has not yet been delivered. You can also add the lyrics PDF there at any time, including after Delivery; we then send it by email and add it to your song page.

The prices of the lyrics PDF and of the upgrade are shown in the currency of your country and are charged in addition to the price of your delivery tier.

We no longer sell a second version of the song or a third verse; orders placed earlier that included either are fulfilled as bought.

Your content

You are responsible for the accuracy of the Customer Content you submit. Please check names, dates, and details before you order: we produce the song exactly as described.

You may not submit Customer Content that is unlawful, hateful, defamatory, obscene, or that infringes someone else's rights, including copyright, trademark, or privacy rights. We may refuse, cancel, or pause an order that breaks this rule, and will refund you in full if we do.

How the song is made

Lyrics and music are produced with the help of AI-assisted music production tools, guided by the answers you give in the wizard, and every song is reviewed and finished by a person on our team before Delivery. The result is unique to your order; it is not selected from a pre-made catalog.

Intellectual property and your license

We, or our licensors, own the underlying rights in the tools, templates, and production techniques used to make your song. On Delivery, we grant you a perpetual, worldwide, non-exclusive, royalty-free license to use your song for personal, non-commercial purposes: listening to it, sharing it with family and friends, posting it on your personal social media, and playing it at private events such as weddings or birthdays.

Commercial use, such as use in advertising, in a business, or in paid content, requires our prior written permission. We retain the underlying rights in your song and will not resell it or license it to anyone else as a stand-alone track.

Revisions

If something in your song does not match what you asked for, tell us within the Guarantee Period and we will make one round of revisions at no extra cost, for example adjusting a name, a detail, or the mix. Further revisions beyond the first round may be offered at our discretion or for an additional fee. A revision never replaces or uses up the money-back guarantee in our Refund Policy: you can still ask for a full refund within the Guarantee Period, including after a revision.

Right of withdrawal

If you are a consumer in the European Union, you normally have a statutory 14-day right to withdraw from an online purchase. Your song is digital content that is not supplied on a tangible medium and is produced to your own specification.

By placing your order you expressly request that we begin production immediately, and you acknowledge that your statutory right of withdrawal is lost once production begins. This does not affect the 30-day money-back guarantee described in our Refund Policy, which we offer independently of, and in addition to, your statutory rights.

Liability

To the extent permitted by law, our liability to you for any claim arising from your order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, such as lost profits or lost opportunities.

Nothing in these Terms limits liability that cannot be limited under the law of the country where we are established or the law of your home country, including liability for death, personal injury, or fraud.

Data protection

We process the personal data you give us, including the Customer Content, to create and deliver your song. Full details are in our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time, for example to reflect a change in our service or in the law. The version in force is the one published at https://customsonggifts.com/terms when you place your order.

Governing law and your rights

These Terms are governed by the laws of the country where we are established, without affecting any mandatory consumer protection rights you have under the law of the country where you live.
